The second\ncassation court of General jurisdiction granted the complaint of lawyer\nAlexander Pogodin by way of selective cassation and changed the verdict of\nNagatinsky district court of Moscow. A sentence for 4 years in prison, the\nperson convicted of fraud received, was replaced from real to conditional. It\nwas found that poverty pushed the Defendant to forge documents to obtain tax\ndeductions for the purchase of housing. The court took into account remorse,\ninsignificance of damage (249 thousand rubles), the fact that it was fully\ncompensated, as well as the presence of the Defendant’s children. The Defendant\nwas defended by Alexander Pogodin, lawyer, Deputy head of MCBA \u201cBureau of\nLawyers \u201cDe jure\u201d.<\/p>\n\n\n\n
By the\ndecision of the Eighth Arbitration Court of Appeal, the Bank’s complaint was\nsatisfied and the ruling of the court of the first instance on the refusal to\ndeclare the transaction invalidated was canceled. The Bank’s transaction was\ndeclared invalid, and more than 1.3 million rubles were returned to the\nbankruptcy estate.
