The court\nrecognized the right of the Principal of MCBA \u201cBureau of Lawyers \u201cDe Jure\u201d to\na land plot and a residential building. The real estate went to the client of\nthe Bureau by will, but it turned out that the property right to the land plot\nwas not registered by the testator, since the Rosreestr removed it from the\ncadastral register. On this basis, the state authorities refused to issue a\ncertificate of inheritance. Our lawyers prepared and filed a claim for the\nrestoration of the archival cadastral number of the land plot and for\nrecognition of its ownership. After that, Rosreestr restored the number of the\nland plot, and the court recognized the ownership right. The Eighth Arbitration\nCourt of Appeal sided with the Client of MCBA \u201cBureau of Lawyers \u201cDe Jure\u201d and\nrefused to the procedural opponents to appeal the decision of the first instance court. Earlier,\nthe Arbitration Court of the Tyumen Region agreed with the legal position of\nthe Bank – Principal of \u201cDe Jure\u201d and excluded from the register of creditors’\nclaims those claims that the Bank itself recognized as subject to exclusion. Persons\ncontrolling the debtor in the appeal asked the exclusion of all requirements of\nthe Bank. The client\u2019s interests were\nrepresented by Ksenia Stikhina, lawyer of the Tyumen branch of \u201cDe Jure\u201d.<\/p>\n\n\n\n
On June 3,\n2020, Zamoskvoretsky District Court of Moscow put an end to the case of a\npolice officer accused of committing a crime under item \u201ca\u201d of part 5 of\nArticle 290 of the Criminal Code of the Russian Federation. According to\ninvestigators, the officer received a bribe for that he together with his\ncolleagues \u201cturned a blind eye\u201d to violations of the bribe giver. This Article\nprovides for punishment from 7 to 12 years in prison with the possibility of\nadditionally imposing a fine of 10 times the size of a bribe, as well as with\nthe deprivation of the right to occupy certain positions or engage in certain\nactivities for up to ten years. The Lawyers of MCBA \u201cBureau of Lawyers \u201cDe\nJure\u201d managed to focus the Court’s attention on the extenuating circumstances\nof the case and the inapplicability of circumstances aggravating guilt. As a\nresult, the Court, guided by the provisions of Article 64 of the Criminal Code\nof the Russian Federation (\u201cAssignment of a milder sentence than provided for\nthis crime\u201d), sentenced the Defendant to 4 years of imprisonment with\ndeprivation of the right to hold office for a term of two years.
