On August 18,\nNikita Filippov, head of MCBA \u201cBureau of Lawyers \u201cDe Jure\u201d, held a webinar on the\nKlerk.ru portal, during which he analyzed in detail the July review of the\nSupreme Court of the Russian Federation, dedicated to the practice of\ncountering illegal financial transactions.<\/p>\n\n\n\n
At the\nbeginning of his speech, Nikita Filippov noted that unscrupulous participants\nin civil transactions have always looked for ways to “launder” – to\nlegalize, that is, to give legal status, income received as a result of\nviolation of the law. One of these increasingly popular methods of money\nlaundering is the so-called judicial legalization – when an attacker goes to\ncourt in order, for example, to use the mechanism of enforcement of judicial\nacts to legitimize the proceeds obtained illegally.<\/p>\n\n\n\n
In his\nspeech, Head of “De Jure” dwelled in detail on the measures to counter\nthe spread of vicious practices taken by the courts, the powers of the courts\nin the presence of signs of illegal financial transactions. \u201cThe judicial system does not stand still and\nseeks to adapt to new ways to bypass the law and thereby legalize the proceeds\nreceived illegally,\u201d – Filippov\nbelieves.<\/p>\n\n\n\n
As examples,\nspecific cases from judicial practice were considered, according to which the\ncourts not only attracted authorized state bodies to participate in the case,\nbut also rejected the claim, despite the acknowledgment of the debt by the\ndefendant.<\/p>\n\n\n\n
Nikita\nFilippov also shared advice on how honest entrepreneurs can protect themselves\nfrom such transactions and not fall into the millstones of Russian justice.<\/p>\n\n\n\n
