III INTERNATIONAL BANKRUPTCY FORUM WAS HELD IN ST. PETERSBURG

On May 16-17, Head of MCBA  «BUREAU OF LAWYERS “DE JURE» Nikita Vladimirovich Filippov took part in the III International Bankruptcy Forum, which took place in St. Petersburg within the framework of the IX St. Petersburg International Legal Forum.

Professionals in the field of bankruptcy from all over the world gathered on one platform.

The rich business program of the Forum included many events at which a wide range of issues related to both the institution of bankruptcy and related industries were discussed: their issues, development prospects, application of modern digital technologies.

International experts shared experience in resolving similar problems in their jurisdictions.

The attitude of the audience to the novelties proposed by the moderators of the sessions in the regulatory regulation of legal relations in the field of bankruptcy was found out by online voting, and not all innovations received the approval of the professional community.

In particular, on the second day of the Forum, N. V. Filippov, taking part in the discussion on the advisability of introducing a legislative ban on the initiation of bankruptcy proceedings before the Claimant passes all stages of enforcement proceedings, expressed fears that the introduction of this ban entails providing an unfair Debtor with an unreasonable additional temporary “head start” to hide the withdrawn assets.

Outcome of the vote of this session – 55/42 against such restriction.

But, of course, most of the ideas for the reform and revision of the Federal Law “On Insolvency (Bankruptcy)”, the procedural legislation and subordinate legislation (including those already introduced as “real” bills to the State Duma) announced by the speakers of the Forum’s events are really urgent and worthy of support that was noted by the participants both during the speeches and on the sidelines, and one of the most positive outcomes of the Forum was the General impression that the Government (Legislative, Executive and Judicial) does not distance itself from the problems of “growth and development” of bankruptcy as a fairly new institution in our law, but works in real contact and dialogue with all participants of bankruptcy legal relations  to resolve them.
