On February 22, 2019, someone came to the Bank’s branch and, having allegedly presented a passport in the name of N., asked to withdraw 100 000 euros and 2 900 000 rubles from two accounts. The Bank, without properly checking the authenticity of the documents, gave all the money.
A few weeks later the Depositor accidentally found out that the accounts were reset to zero without his knowledge. To restore justice, he appealed to MCBA “Bureau of Lawyers “De jure”. A claim was prepared and filed for damages in the amount of 100 000 euros and 2 990 000 rubles, interest on deposits for the entire period of lack of money on the accounts, penalties (according to Article 856 of the Civil Code of the Russian Federation), as well as a fine under the Law “On Protection of Consumer Rights”.
4 days before the first court session, the Bank restored money on deposits. In addition, the Bank provided evidence of a reasonable interest charge.
As a result, the court collected penalties and a fine from the Defendant.
