August 6. MAIN RESULTS OF THE DAY

The First Court of Appeal of General Jurisdiction upheld the decision of the Moscow City Court to satisfy the claims of a Client of MCBA “Bureau of Lawyers “De Jure” in the framework of the case on challenging the cadastral value of the property.  Despite the active resistance of the City Property Department, lawyers of “De Jure” have achieved a decrease in the cadastral value of almost 40 million rubles (by 20%).  The interests of the Client were represented by Ilsur Zakirov, lawyer of BA “De Jure”.

The Ninth Arbitration Court of Appeal upheld the decision of the Moscow Arbitration Court, which refused to satisfy the claims against the Client of MCBA “Bureau of Lawyers “De Jure”. The homeowners’ association demanded to invalidate the transaction for the acquisition of property in the framework of enforcement proceedings. The claims were based on the fact that the premises transferred to the Respondent’s ownership were allegedly the common property of an apartment building. Lawyers of MCBA “Bureau of lawyers “De Jure” managed to prove that the disputed real estate does not have the features of common property. The interests of the Respondent were defended by Elena Ivanova, lawyer of MCBA “Bureau of Lawyers “De Jure”.
