The Moscow City Court upheld the decision of Khamovnichesky District Court, according to which the Principal of MCBA “Bureau of Lawyers “De Jure” was acquitted under part four of Article 159 of the Criminal Code, and the acquitted party retained the right to rehabilitation. During the long trial (only during the trial the Client was under house arrest for two years) lawyers of MCBA “Bureau of Lawyers “De Jure” was able to prove that the actions of the client did not contain any signs of a crime within the framework of the act incriminated to her. The client was defended by Pavel Sorkin, lawyer of MCBA “Bureau of Lawyers “De Jure”.
The Ninth Arbitration Court of Appeal left unchanged the previously issued judicial act of the Arbitration Court of Moscow on the refusal to include the applicant’s claim in the amount of USD 1 million to the bank’s register of creditors. The courts agreed with the position of the bankruptcy Trustee of the Bank that the presentation of the bill by the Applicant is not an unconditional basis for inclusion in the register, other circumstances are also subject to verification, including the circumstances of the issuance of the bill, and the economic feasibility of the transaction. The interests of the bankruptcy Trustee of the Bank were represented by Sergey Bibikov, lawyer of MCBA “Bureau of Lawyers “De Jure”.
The First Court of Appeal of General Jurisdiction left unchanged the earlier decision of the Moscow City Court on the dispute between the Principal of MCBA “Bureau of Lawyers “De Jure” and the Moscow City Property Department. Within the framework of this dispute, the Bureau was able to prove the existence of grounds for reducing the cadastral value of real estate owned by the Principal from 344 million rubles up to 188 million rubles. As a result, the tax burden on the Principal has been significantly reduced; part of the tax payments is subject to refund. The interests of the Principal were represented by Ilsur Zakirov, lawyer of the Bureau.
The Moscow Arbitration Court fully satisfied the claim of the Bureau’s client for recovery of 3.1 million rubles of the Principal debt, interest, including for the future period, as well as expenses for payment of the state fee. Within the framework of this dispute, we managed in one session to move from the stage of the preliminary court session to the main one and “come to a decision”, which significantly saved our client time costs.
