September 21. MAIN RESULTS OF THE DAY

The appeal ruling of the Moscow City Court upheld the earlier decision of Presnensky District Court of Moscow to satisfy the Bank’s claim to recover debt under a loan agreement in the amount of more than USD 200,000, as well as foreclosure on a land plot.  The interests of the Bank in the courts of the first and appeal instances were represented by Konstantin Glushkov, senior lawyer of MCBA “Bureau of Lawyers “De Jure”.

 The Arbitration Court of the Moscow District overturned the judicial acts of the Arbitration Court of the Moscow Region and the Tenth Arbitration Court of Appeal, which collected interest on a commercial loan and a penalty under the supply agreement in the total amount of 4.4 million rubles from the Principal of MCBA “Bureau of Lawyers “De Jure” with reference to non-fulfillment of the settlement agreement approved by the Arbitration Court of the Moscow Region on a previously considered court case.  The interests of the Principal were represented by Rashid Gitinov, senior lawyer of MCBA “Bureau of Lawyers “De Jure”.

The Ninth Arbitration Court of Appeal satisfied the appeal of the Client of MCBA “Bureau of Lawyers “De Jure”, canceled the previously adopted ruling of the Arbitration Court of Moscow and refused to include the creditor affiliated with the debtor in the register of creditors’ claims over 100 million rubles.  The interests of the Client of MCBA “Bureau of Lawyers “De Jure” were represented by Taisiya Radchenko, lawyer of MCBA “Bureau of Lawyers “De Jure”.
