October 15. MAIN RESULTS OF THE DAY

The Moscow Arbitration Court satisfied the claim of the Client of MCBA “Bureau of Lawyers “De Jure” and recovered from his procedural opponent a debt of about 1.4 million rubles.  Also, the Moscow Arbitration Court, within the framework of simplified proceedings, satisfied 3 claims of the same Client for debt recovery for a total amount of approximately 1.1 million rubles.  The interests of the Client are represented by  Yakov Bulut and Ramzan Mezhidov, attorney and lawyer of MCBA “Bureau of Lawyers “De Jure”.

The Second General Jurisdiction Court of Cassation dismissed the Plaintiffs’ cassation appeal.  Earlier, at first, Zamoskvoretsky District Court of Moscow dismissed the Plaintiffs in a claim against the Client of MCBA “Bureau of Lawyers “De Jure” for the protection of consumer rights, invalidation of the clauses of the contract, the recovery of funds, compensation for moral damage, a fine, and then the Moscow City Court upheld this decision.  The client’s interests were defended by Rashid Gitinov, lawyer of MCBA “Bureau of Lawyers “De Jure”.

The Moscow Arbitration Court satisfied the application of the bankruptcy Trustee of the Debtor and declared invalid transactions of transferring bonuses to the former chief accountant of the Debtor in the amount of 10 million rubles.  The consequences of challenging the transaction were applied in the form of collecting the specified amount from the Defendant. In the course of the trial, the lawyers of MCBA “Bureau of Lawyers “De Jure”, acting as representatives of the Debtor’s creditor, managed to prove that the chief accountant not only had no right to the bonuses, but simply ruined the company’s financial year.  The arbitration court agreed with this conclusion of the Creditor and declared the transaction invalid.  The interests of the Creditor were represented by Andrey Khokhlov, lawyer of MCBA “Bureau of Lawyers “De Jure”.
