November 10 Main results of the day

The Second Cassation Court of General Jurisdiction refused our procedural opponents in satisfying the cassation appeal and upheld the appeal ruling of the Moscow City Court in the case on the claim for the recovery of a contractual penalty in the amount of 6.67 million rubles from the Principal of MCBA “Bureau of Lawyers “De jure”.  In the third round, the courts, taking into account Article 404 of the Civil Code of the Russian Federation (on the fault of the creditor regarding the failure to offset the debt and the security payment), refused to satisfy 80% of the stated claims.  The case was led by Rashid Gitinov, senior lawyer of MCBA “Bureau of Lawyers “De jure”, the interests of the Principal were represented in the court of cassation by Yulia Meshkova, lawyer of MCBA “Bureau of Lawyers “De jure”.
