The First Court of Appeal dismissed the appeal of the Moscow City Property Department and upheld the earlier decision of the Moscow City Court, by which MCBA “Bureau of Lawyers “De jure” managed to successfully challenge the size of the cadastral value of real estate objects owned by the Client, reducing it by almost 30% (37 million rubles). The interests of the Client in the court of appeal were represented by Denis Amelchenko, lawyer of MCBA “Bureau of Lawyers “De jure”.
The Arbitration Court of Moscow fully satisfied the claim of the tenants of the apartment building, whose interests were represented by MCBA “Bureau of Lawyers “De jure”, for the recognition of the land plot lease agreement in part. During the trial, we were able to prove that the disputed site is a historically established adjoining territory of the residents of the house and the City Property Department, together with the developer, had no right to dispose of it. The interests of the residents were represented by Nikita Filippov, Head of MCBA “Bureau of Lawyers “De jure”, and Aleksey Te, Deputy Head.
