The Arbitration Court of the city of Moscow satisfied the application of a Client of MCBA “Bureau of Lawyers “De jure” and, despite the Defendant’s objections, recovered from him court costs in the amount of more than 90 thousand rubles. The Client’s interests were represented by Ramzan Mezhidov, lawyer of MCBA “Bureau of Lawyers “De jure”.
The Arbitration Court of the Moscow District, having considered the complaint of the Department of Municipal Property of the City of Moscow, left unchanged the adopted judicial acts in the case. Earlier, the Department filed a lawsuit against the Principal of MCBA “Bureau of Lawyers “De jure” to recognize the building as an unauthorized construction and its demolition. During the court dispute, the Bureau managed to prove that the Department, concluding a land lease agreement in 2011, was aware of the location of the building on this land plot, and in 2016, the Department drew up an inspection report, which testifies that the statute of limitations was missed, while the constructed property does not create a threat to life and health of citizens. Taking into account the proven legal position, the Arbitration Court of the City of Moscow denied the claim of the Department. The Ninth Arbitration Court of Appeal also agreed with the position of the Bureau and the conclusions of the Court of first instance. The interests of the Principal in the court of cassation instance were represented by Head of the Bureau Nikita Filippov.
