The Ninth Arbitration Court of Appeal refused to the procedural opponents of MCBA “Bureau of Lawyers “De jure” in satisfying the application for review on newly discovered circumstances. The court, taking into account the explanations of the lawyers of the Bureau, recognized that the circumstances indicated in the statement of the opponents are not newly discovered. Earlier, the court of appeal overturned the decision of the Arbitration Court of Moscow and denied the claim to recover 25 million rubles from the Principal of the Bureau. The interests of the Principal were represented by Nikita Filippov, Head of MCBA “Bureau of Lawyers “De jure”, and Yulia Martynenko, lawyer of the Bureau.
The Moscow City Court overturned the decision of Timiryazevsky District Court of Moscow, which had previously been granted a claim to recover 270 thousand rubles from the Client of the Bureau, and refused to satisfy the claim filed against the Client in full. The Client’s interests were represented by Semyon Garayan, Senior Lawyer of MCBA “Bureau of Lawyers “De jure”.
Lyubertsy City Court of the Moscow Region fully refused to satisfy the claim filed against the Principal of MCBA “Bureau of Lawyers “De jure” on the recognition of the contract of donation of a residential building as not concluded. The Plaintiff insisted that he did not sign the donation agreement and false substrate documents were presented for state registration of ownership. During the process, lawyers of MCBA “Bureau of Lawyers “De jure” managed to convince the court that the stated requirements have no legal grounds and are abuse of the right, and in addition, the Plaintiff missed the limitation period. The interests of the Principal in the court were represented by Nikita Filippov, Head of MCBA “Bureau of Lawyers “De jure”, lawyer Tatyana Bogomolov also participated in the formation of the legal position.
