The 2nd Meshchansky District Court of Moscow terminated the criminal case and released the Principal of MCBA “Bureau of Lawyers “De jure” from criminal liability. The investigating authorities brought charges against the Principal under clause “з” of Part 2 of Article 111 of the Criminal Code of the Russian Federation (deliberate infliction of grievous bodily harm with the use of weapons or objects used as weapons). He was threatened with imprisonment for up to ten years with or without restriction of liberty for up to two years. But as a result of a competent defense strategy, the court reclassified the committed crime to Article 115 of the Criminal Code of the Russian Federation (causing minor harm to health), released the Principal from criminal liability and terminated the criminal case. The Client was defended by lawyer of the Bureau Sergei Zagrebelny.
The Arbitration Court of the Moscow District, within the framework of the bankruptcy case, canceled the judicial acts of the lower courts and sent the case for a new trial. Earlier, the Principal applied to the Bureau at the stage of appeal against the court decision, which by that time had already decided to bring the Principal to subsidiary liability for a total amount of 4.6 billion rubles. The case was complicated by the fact that practically no documents confirming the Client’s innocence were submitted to the court of first instance. The lawyers of the Bureau managed to attach a large amount of evidence to the court of appeal, but the ruling was upheld. In cassation, we continued to insist on our line of defense, and as a result of studying the arguments of the complaint, the cassation court found them justified and canceled the unlawful judicial acts. The Ninth Arbitration Court of Appeal upheld the decision of the first instance court, which refused to satisfy the claim against the Principal of MCBA “Bureau of Lawyers “De jure” under a construction contract for a total amount of 525 million rubles. The Moscow Arbitration Court satisfied the Customer’s claim and collected from the Defendant the amount of unearned advance payment in the amount of 58 million rubles. The Fourth Cassation Court of General Jurisdiction recognized the position of MCBA “Bureau of Lawyers “De jure” as justified and canceled the appeal ruling of the Rostov Regional Court. Earlier, the court of appeal unlawfully satisfied the claim brought against the Client of the Bureau for the transfer of an apartment in a building under construction in the absence of any contractual relations between the Client and the Plaintiff. The Client’s interests were represented by Ilsur Zakirov, senior lawyer of the Bureau.
The Ninth Arbitration Court of Appeal left unchanged the ruling of the court of first instance on the recovery of court costs in the amount of more than 300 thousand rubles from the Plaintiff in favor of the Principal of the Bureau in connection with the unjustified filing of a claim against the Principal. The Arbitration Court of the Moscow Region granted the petition of MCBA “Bureau of Lawyers “De jure” and left without consideration the statement of claim brought against the Client of the Bureau within the framework of a corporate dispute. The Moscow City Court overturned the decision of the court of first instance, considered the case according to the rules of first instance, as a result of which it satisfied the claim of the Client of the Bureau for the eviction of the Defendant and his family members from the apartment.
