Zamoskvoretsky District Court of Moscow granted the petition of MCBA “Bureau of Lawyers “De jure” and left without consideration the statement of claim filed against the Educational Organization in the framework of a dispute on consumer rights protection. The interests of the Educational Organization were represented by Semyon Garaya, senior lawyer of the Bureau.
The Ninth Arbitration Court of Appeal left unchanged the ruling of the court of the first instance on the recovery of court costs in the amount of more than 300 thousand rubles from Mosenergosbyt JSC in favor of the Principal of the Bureau in connection with the unjustified filing of a claim in the amount of 2 million rubles against the Principal. Earlier, the Moscow Arbitration Court satisfied this claim in full. The Principal found out about the decision made only after the funds were debited from his account. The client applied to the Bureau for the protection of his interests. Based on the legal position of the Bureau, the appellate instance canceled the decision and refused to satisfy the claims against the Principal in full. In this regard, the Bureau provided proper evidence of the Principal’s expenses for paying for the services of a representative in the amount of 300 thousand rubles, which was satisfied in full, postal expenses and expenses for paying the state fee were also collected. The interests of the Principal were represented by senior lawyer Polina Arkannikova.
The Arbitration Court of the Moscow District refused to satisfy the complaint of the procedural opponents of MCBA “Bureau of Lawyers “De jure” against the ruling of the appellate court on the refusal to review the case due to newly discovered circumstances. Earlier, the court of appeal refused to the procedural opponents to recover debts in the amount of more than 25 million rubles from the Client of the Bureau. The Client’s interests were represented by Yulia Martynenko, lawyer of MCBA “Bureau of Lawyers “De jure”.
