The Ninth Arbitration Court of Appeal dismissed the appeal of the procedural opponents of MCBA “Bureau of Lawyers “De jure”. Within the framework of this dispute, the Client of MCBA “Bureau of Lawyers “De jure” filed an application to the Moscow Arbitration Court for declaring the Debtor bankrupt. In order to terminate the proceedings, the Debtor made a partial repayment of the debt owed to the Client, while the financial sanctions and the cost of paying the state fee remained unpaid. MCBA “Bureau of Lawyers “De jure” declared the abuse of the Debtor’s right, since the amount of the remaining unpaid claims was below the minimum threshold for the introduction of bankruptcy proceedings. Under these circumstances, the court of first instance refused to satisfy the Debtor’s application to terminate the proceedings. The Court of Appeal also recognized the above conclusions as correct, and the arguments of the appeal as unfounded. Now, in order to terminate the proceedings, the Debtor will have to pay the entire amount owed to the Client, otherwise he will be declared bankrupt. The Client was represented by Roman Volkomorov, lawyer of the Tyumen branch of Bureau of Lawyers “De Jure”, and Ksenia Stikhina, senior lawyer of the Tyumen branch.
