The bailiff, at the request of MCBA “Bureau of Lawyers “De jure”, arrested more than 700 vehicles of PJSC MOEK in connection with the non-payment of the latter’s debt in the amount of 145 thousand rubles confirmed by the court. The arrest warrant itself is written on 169 pages. Thus, as a result of the refusal to pay a small amount of debt on a voluntary basis, all automobile equipment of PJSC MOEK was under arrest and the threat of confiscation for subsequent sale at a public auction. The debt of PJSC MOEK itself also arose as a result of illegal actions of PJSC MOEK. In the summer of 2020, during the Moscow lockdown period, the Company – a client of MCBA “Bureau of Lawyers “De jure” – did not actually use the premises it owned, and therefore practically no heat supply was consumed. Despite the presence of installed heat supply meters, PJSC MOEK considered the obtained readings to be abnormally low and calculated the maximum possible indicators of heat energy consumption using the calculation method, issued an appropriate invoice and threatened to turn off the heat energy supply in case of non-payment. The company was forced to make the payment, but at the same time it appealed to the Moscow Arbitration Court, proved the dishonest behavior of PJSC MOEK and collected in its favor both the amount of the payment made and interest for the use of other people’s funds for the past and future periods until the moment of full payment debt. The interests of the Client were represented by Yakov Bulut, lawyer, head of the practice of resolving economic disputes of MCBA “Bureau of Lawyers “De jure”.
