The Kuzminskiy District Court of Moscow satisfied the claim of Andrei Makarov, the Principal of the lawyer of MCBA “Bureau of Lawyers “De jure”, and recovered more than 3 million rubles from the Defendant for non-fulfillment of the contract for the provision of paid services. The Defendant for 1 million rubles guaranteed the Principal to provide services for the most beneficial solution for the Principal to resolve the issue of resettlement in the manner of renovation, but he did not fulfill his promises. The issue of filing a fraud application is also being considered. The interests of the Principal were represented by Andrey Makarov, lawyer of MCBA “Bureau of Lawyers “De jure”.
The Moscow Arbitration Court refused a Creditor to include the debt in the amount of 1.4 million rubles in the register of creditors’ claims of the Debtor. The interests of the Debtor were represented by Marina Nikolaenko, the head of the practice.
The Ninth Arbitration Court of Appeal upheld the decision of the court of first instance, which satisfied the claim of the Principal of MCBA “Bureau of Lawyers “De jure” to recover from PJSC MOEK unjustified enrichment and interest for the use of other people’s funds. The Court agreed with the Bureau’s position that the use of the settlement method by PJSC MOEK entails unjustified billing of volumes that the company did not actually consume, which contradicts Article 544 of the Civil Code of the Russian Federation. The interests of the Principal were represented by Yakov Bulut, lawyer, the head of the practice of resolving economic disputes of MCBA “Bureau of Lawyers “De jure”.
