The Arbitration Court of the Stavropol Territory fully satisfied the application of the Client of MCBA “Bureau of Lawyers “De jure” for inclusion in the register of claims of the bankrupt company of more than 38 million rubles of debt outstanding by the debtor. This will allow the Client of the Bureau to have advantages over other creditors in the framework of the subsequent bankruptcy procedure. At the same time, the lawyers of the Bureau managed to prove the unfoundedness of the debtor’s petition to suspend the proceedings and the statement about falsification of the applicant’s evidence. The interests of the Client of the Bureau were represented by Yakov Bulut, lawyer, head of the practice of resolving economic disputes.
The Ninth Arbitration Court of Appeal dismissed the procedural opponents of MCBA “Bureau of Lawyers “De jure” and upheld a previously issued judicial act, which refused to satisfy the requirements for declaring the auction invalid. The Collegium of the court took into account the argument of the representative of the Bureau that the judicial act on the appointment of the procedure for the distribution of the discovered property of the liquidated legal entity does not confirm the ownership of the disputed property. The interests of the Bank were represented by Vladimir Leonov, senior lawyer of MCBA “Bureau of Lawyers “De jure”.
The Arbitration Court of the Moscow District upheld the decisions of the courts of the first and appeal instances, which recovered the debt in the amount of 4.4 million rubles in favor of the Client of MCBA “Bureau of Lawyers “De jure” under the lease agreement. At the same time, the counterclaim to recover 37 million rubles from the Client of the Bureau was refused in full.
