After the break, the Moscow City Court upheld the decision of the Cheremushkinsky District Court of Moscow to refuse the spouse of the Client of MCBA “Bureau of Lawyers “De jure” in the division of the apartment. The appeal of the procedural opponent was dismissed. The lawyers of the Bureau brought to the attention of the court the position on the expiration of the statute of limitations, the lack of evidence of additional payments under the exchange agreement and the presence of inseparable improvements in the apartment made by the spouse. The apartment has been recognized as the personal property of the client of MCBA “Bureau of Lawyers “De jure”. The Client was represented by Sergey Bibikov, senior lawyer of MCBA “Bureau of Lawyers “De jure”.

The Moscow Arbitration Court has terminated proceedings in the case of recovering debt in the amount of 130 million rubles from the Client of MCBA “Bureau of Lawyers “De jure”. In September 2021, the Plaintiff’s bankruptcy trustee filed a lawsuit to recover the principal debt, interest and penalties under the loan agreement. During the trial, evidence was provided of the groundlessness of the Plaintiff’s claims, in connection with which he declared a waiver of the claim. The Arbitration Court of the Central District refused to satisfy the cassation appeal of the procedural opponents of the Client of MCBA “Bureau of Lawyers “De jure”. The lawyers of the Bureau managed to fully defend the previously adopted judicial acts of the lower instances. The opponent in the dispute declared the nullity of the offset of mutual claims in the amount of 28 million rubles, as well as the invalidity of some provisions of the concluded agreements. The Court of Cassation instance took the side of the Client of the Bureau after several postponements and multiple explanations from both sides. The Client’s interests were represented by Yakov Bulut, lawyer, head of the practice of resolving economic disputes.

The Moscow Arbitration Court has approved a settlement agreement between the Client of MCBA “Bureau of Lawyers “De jure” and a subsidiary of Russia’s largest mobile operator. The dispute between the parties arose regarding the quality of the delivered telecommunications equipment and the recovery of a penalty for violation of the delivery period. The total cost of the claim is 14 million rubles. The Plaintiff agreed that, taking into account the objections presented by the lawyers of the Bureau, it would be better to end the case with an amicable agreement. As a result, the parties agreed on partial repayment of claims in the amount of 7 million rubles.
