Lawyers of MCBA “Bureau of Lawyers “De jure” succeeded in dropping the claim against our Client, proving to the court and opponents the groundlessness of their claim and the futility of further consideration of the dispute. During the consideration of the claim against the Client of the Bureau of Lawyers “De Jure” for the reclamation of 633 tons of petroleum bitumen from him, the Plaintiff, after the announcement of our legal position on the groundlessness of the claim, asked to postpone the court session to receive answers to requests. But the lawyers of the Bureau prepared counterarguments in advance, taking into account the specifics of the conduct of cases of a particular judge, in connection with which, the Plaintiff completely abandoned his claims directly at the court session. The rights and legal interests of the Bureau’s Client were represented by Yakov Bulut, Head of the practice of resolving economic disputes, and lawyer Dan Khorolets.
The Moscow City Court issued an appeal ruling on a labor dispute, which left the appeal of the procedural opponent of the Bureau of Lawyers “De jure” without satisfaction, the decision of the Lublinsky District Court of Moscow, rendered in favor of the Employer – the Principal of the Bureau, is unchanged. We managed to prove the groundlessness of the employee’s claims for payment of sums of money, which he qualified as “gray” wages, and also to confirm the legality of the order issued by the Employer to suspend the Employee from work. The Ninth Arbitration Court of Appeal refused to satisfy the borrower’s appeal against the decision of the court of first instance to refuse to terminate the loan agreement with the Client of the Bureau. The court did not see in the debtor’s arguments a significant change in circumstances due to the spread of Covid-19, which allows the debtor to terminate the contract in court. The financial obligations of the debtor under the loan agreement in the form of payment of interest on the loan on the date of actual repayment and penalties in the amount of more than 25 million were left in force.
