The Moscow Arbitration Court in the framework of a dispute on the recovery of a penalty in the amount of 6.5 million rubles from the Defendant agreed with the legal position prepared jointly by Tatyana Bogomolova, lawyer of MCBA Bureau of Lawyers “De Jure” and Alexey Bakanov, lawyer of BA “Moscow Law Center”, and refused to satisfy the claim against their Principal in full. The basis for filing this claim was the fact of delay in the execution of work by the Defendant in accordance with the technical documentation regarding equipment for two military vessels. At the same time, the lawyers managed to prove that the Defendant was not at fault for the delay, since it occurred for reasons beyond the Defendant’s control.
