The Odintsovo City Court of the Moscow Region agreed with the arguments of Yuliy Darinsky, lawyer of the Bureau of Lawyers “De jure”, and refused to satisfy the claim against the Principal for the recovery of more than 22 million rubles in full. The claims were motivated by the fact that during the period of cohabitation of the parties, before the registration of the marriage, a residential house and a land plot were registered as the property of the Principal at the expense of the Plaintiff. At the same time, the Plaintiff presented irrefutable evidence in support of the stated claims. But Yuliy Darinsky managed to convince the court that there were no legal grounds for satisfying the claim, since, in accordance with civil law, unjustified enrichment received in the absence of obligations is not refundable, and in addition, the Plaintiff missed the statute of limitations.
