The Ninth Arbitration Court of Appeal refused to satisfy the appeal of the opponent of the Principal of the Bureau of Lawyers “De jure”. Earlier, the decision of the Moscow Arbitration Court refused to satisfy the claim against the Principal for recovery of the amount of damage caused as a result of a traffic accident. The appellant motivated his position with an administrative order, which described the Principal’s collision with another car, which, according to the Plaintiff, testified to the Defendant’s guilt. The Bureau’s staff provided counterarguments with reference to stable judicial practice, according to which evidence of guilt is required to bring to responsibility, which cannot include descriptions of an accident. As a result of the work done, the Bureau’s employees managed to protect the Principal from unjustified recovery of damages. The interests of the Principal were represented by Ksenia Stikhina, senior lawyer of the Bureau of Lawyers “De jure”.
The Kalininsky District Court of Tyumen city satisfied the application of the Principal of the Bureau of Lawyers “De jure” to recognize the fact of entering into the inheritance. The complexity of the dispute was that the real estate which was part of the inheritance was not in the Unified State Register of Real Estate. During the consideration of the case, the employees of the Bureau of Lawyers “De jure” presented to the court exhaustive evidence confirming both the existence of real estate and the legitimacy of the Principal’s claims, which fully convinced the court of the validity of the stated requirements. The interests of the Principal were represented by Ivan Bychkov, Head of the Tyumen branch of the Bureau of Lawyers “De jure”.
The Arbitration Court of the Moscow District agreed with the arguments of the lawyers of the Bureau of Lawyers “De jure” and canceled the judicial acts of lower courts on the recovery of unjustified enrichment in the amount of 3 million rubles from the Client of the Bureau. The judicial collegium of the cassation instance noted that the conclusions of the lower courts do not correspond to law enforcement practice, including the conclusions of the Supreme Court of the Russian Federation in a similar case, in which the lawyers of the Bureau took part. The Client’s interests were represented by Alexander Uchaykin, senior lawyer of the Practice of Resolving Economic Disputes at the Bureau of Lawyers “De jure”.
