The Second Cassation Court of General Jurisdiction satisfied the cassation appeal of the Bureau of Lawyers “De jure” and canceled the judicial acts of lower instances, which satisfied the requirements for the allocation of the deceased spouse’s share in the jointly acquired property, recognition of the deceased’s ownership of this property, foreclosure on the allocated share. Despite the fact that we were involved in the consideration of the case already after the decision was made by the court of first instance, the Bureau of Lawyers “De jure” managed to convince the collegium that the courts of lower instances committed serious violations of substantive and procedural law when considering the case, which are an unconditional basis for the cancellation of judicial acts with the return of the case for a new trial to the court of first instance.
