Nikita Filippov, Head of the Bureau of Lawyers “De jure”, took part in a meeting of the “Shared Construction” section of the Expert Council on Construction, Building Materials Industry and Problems of Shared Construction under the State Duma Committee on Construction, Housing and Communal Services. During the meeting, Nikita Filippov made a report on the legal approaches of the courts to the issue of calculating the penalty for the delay in the transfer of a shared-equity construction object, as well as on the prospects for applying the provisions of Article 333 of the Civil Code of the Russian Federation after the end of the moratorium on the collection of a penalty. The report also highlighted the issues of the application of the mediation procedure in disputes concerning the quality of shared-equity construction objects being transferred, initiatives were proposed on the possibility of excluding the reduction of the penalty under Equity participation agreement for citizens acquiring shared-equity construction facilities for personal use, not related to entrepreneurial activity. At the same time, the size of the penalty itself can be adjusted by linking it to the consumer price growth index.
