The Moscow City Court left unchanged the decision of the court of first instance on contesting the notary’s actions to deposit funds by the creditor of the bankrupt debtor in the notary’s deposit in the name of the complainant. During the trial, thanks to the active participation of the Bureau, it was confirmed that no violations were committed when accepting money on deposit by the notary, the notary is not obliged to investigate the reasons for the debtor’s failure to fulfill his obligations to the creditor, including those that arose during the bankruptcy of the debtor. The peculiarity of this dispute was that one of the debtor’s creditors tried to relocate the consideration of the dispute on the eligibility of paying off his claims to the RTC of the bankrupt debtor and his procedural replacement to the court of general jurisdiction, referring to the illegality of the notary’s actions. The Arbitration Court of the Stavropol Territory completely refused to satisfy the claim against the Client of the Bureau of Lawyers “De jure” for invalidation of transactions in the amount of 106 million rubles concluded by him. Lawyers of the Bureau managed to prove the Plaintiff’s dishonesty, numerous attempts on his part to conceal legally significant circumstances for the case, as well as the interest of the experts who prepared a biased conclusion on a comprehensive examination. In addition, the lawyers of the Bureau revealed the Plaintiff’s intentions to covertly include completely new claims in the statement of clarification of claims, for which the limitation period has passed, in connection with which the Arbitration Court of the Stavropol Territory, at our request, will additionally decide on the imposition of a fine on procedural opponents for disrespect for the court and participants in the process.
