The Ninth Arbitration Court of Appeal reversed the decision of the Moscow Arbitration Court and recovered more than 70 million rubles from the Defendant in favor of the Principal of the Bureau of Lawyers “De jure”(compensation for damages and a penalty under the contract). The appellate instance agreed with the arguments of the Bureau on the existence of irreparable violations committed by the court of first instance and experts in the appointment and production of a handwriting examination, as a result of which it ordered a re-examination, based on the results of which, taking into account the sufficiency of evidence of the fact of causing losses and its size, fully satisfied the prepared by lawyers Bureau of Lawyers “De jure” complaint. The interests of the Principal were represented by Nikita Filippov, Head of the Bureau of Lawyers “De jure”. Rashid Gitinov took part in the formation of the position.
The Moscow City Arbitration Court satisfied the application of the Client of the Bureau of Lawyers “De jure” and recovered from the Plaintiff the court expenses in the amount of 130 thousand rubles for paying for the services of a representative. Earlier, the lawyers of the Bureau achieved a partial refusal to satisfy the claim filed against the Client, reducing the amount claimed in the claim by 50% (from 7 million rubles to 3.5 million rubles), and in the court of appeal they received a complete refusal from claims brought against its Principal. The legality of these decisions was also confirmed by the courts of cassation, including the Supreme Court of the Russian Federation. The Client’s interests were represented by Dan Khorolets, senior lawyer of the Practice of resolving Economic Disputes at the Bureau of Lawyers “De jure”.
