The Moscow Regional Court, as part of a dispute over the division of jointly acquired property, approved a settlement agreement between the former spouses. Within the framework of the agreements reached, not only the claims stated in the lawsuit were settled, but also other disputed relations between the parties. Initially, the court doubted the possibility of approving the amicable agreement in such a wording, but the Bureau’s lawyers managed to convince it that such an approach is fully corresponds to modern judicial practice. The Principal’s interests were represented by Nikita Filippov, Head of the Bureau of Lawyers “De jure”, Ekaterina Bulygina, senior lawyer of the Bureau of Lawyers “De jure”, participated in the formation of the position and preparation of documents.
The Moscow City Court issued a decision by which it satisfied the claims of the Principal of the Bureau of Lawyers “De Jure” on invalidation from January 01, 2022 of the paragraph of the annex to the decree of the Government of Moscow “On determining the list of real estate objects in respect of which the tax base is determined as cadastral value”, as well as on recovery from the Government of Moscow in favor of the Principal of the Bureau of Lawyers “De jure” expenses in the amount of 4,500 rubles for payment of the state fee. As part of the dispute, the Moscow Government submitted an act on the actual use of a non-residential building for tax purposes, according to which the object is actually used for business, administrative or commercial purposes, on the basis of which it was included in the relevant List. The Bureau of Lawyers “De jure” managed to prove that the survey report does not meet the requirements of the current regulations of the Moscow Government itself, and the subsequent calculations of the Moscow Government are incorrect and inconsistent with the Methodology for determining the type of actual use of non-residential buildings (structures, structures) for tax purposes. The interests of the Principal were represented by Irina Novikova, senior lawyer of the practice of resolving disputes with state bodies of the Bureau of Lawyers “De jure”.
