The Odintsovo City Court of the Moscow Region satisfied the administrative claims of the Principal of the Bureau of Lawyers “De jure” against the head of the Odintsovo District Department of Bailiffs of Department of the Federal Bailiff Service of Russia for the Moscow Region in connection with the failure to take measures to initiate enforcement proceedings and foreclose on collateral. During the trial, the court found that during the year the office of the Odintsovo District Department of Bailiffs did not respond to any appeal from the administrative Plaintiff, thereby violating his right to judicial protection. The interests of the Principal were represented by Sergei Bibikov, senior lawyer of the Bureau of Lawyers “De jure”.
The Moscow City Arbitration Court, taking into account the position of the lawyers of the Bureau of Lawyers “De jure”, refused to grant the debtor of our Principal the installment plan for repayment of credit debt for a period of 1.5 years. During the trial, the lawyers of the Bureau were able to prove the absence of a relationship and a causal relationship between sanctions restrictions and business losses of the debtor for renting out premises to the restaurant business. In addition, based on the information obtained from the materials of the enforcement proceedings and open databases, the lawyers of the Bureau managed to provide the court with information about the debtor’s property, which could be used to pay off the current interest on the loan without prejudice to the debtor’s core business activities. The interests of the Principal in this dispute were represented by Alexandra Reznichenko and Sergey Bibikov, senior lawyers of the Bureau of Lawyers “De jure”.
