The Arbitration Court of the Moscow District upheld the decisions of the courts of the first and appellate instances on the refusal of state registration of ownership of a commercial real estate object in the center of Moscow. The Bureau of Lawyers “De jure” in this dispute represented the interests of third parties – bona fide owners of real estate, information about which was unlawfully “doubled” in the Unified State Register of Real Estate. The Bureau’s employees proved to the courts that the information about the disputed object was entered into the Unified State Register of Real Estate illegally; the property is not subject to independent cadastral registration and is the property of the Principals. In addition, it was also possible to confirm the Plaintiff’s lack of legal claims in relation to the disputed object. The Moscow City Arbitration Court dismissed the claims of the procedural opponent of the Bureau of Lawyers “De jure” for the recovery of 12.5 million rubles from the Principal of the Bureau under a supply agreement. The counterclaim of the Principal was satisfied, 5 million rubles were recovered from the procedural opponent. In the course of the process, the lawyers of the Bureau managed to prove the inconsistency of the opponents’ statement about the falsification of evidence, in connection with which the court refused their petition to demand the Principal’s accounting documentation and conduct an examination of the statute of limitations. The Arbitration Court of the Tyumen Region promptly completed the bankruptcy proceedings against the Principal, releasing it from unsustainable debt obligations in the amount of more than 11 million rubles, despite the objections of one of the creditors, who asked the Court to refuse to write off debts during the bankruptcy proceedings.
