The Arbitration Court of the Moscow District canceled the judicial acts of lower instances on the inclusion of the creditor’s claims in the amount of more than 700 million rubles in the register of the debtor’s creditors’ claims. Lawyers of the Bureau represented the interests of the majority creditor, whose claims are secured by collateral. The main task set by the Client for the Bureau has been achieved – the lawyers of the Bureau did not allow the creditor, whose claims are based on imaginary transactions, to be included in the register of debtor’s claims. The Second Cassation Court of General Jurisdiction refused to satisfy the cassation appeal of the procedural opponents of the Bureau of Lawyers “De jure” and left unchanged the decision of the Simonovsky District Court of Moscow and the appeal ruling of the Moscow City Court. Within the framework of this dispute, the applicant in the case of contesting the auction organized by the Department for Competition Policy of Moscow City was denied satisfaction of the claim for the recognition of the auction as invalid. The Court of Cassation instance agreed with the arguments of the Bureau of Lawyers “De jure” that the person contesting the auction must prove not only the violations committed during the auction, but also his interest in the consequences of declaring the auction invalid. In addition, the Court of Cassation instance took into account that the property was not acquired by the winner in the disputed auction and was sold at independent auctions, in which the applicant did not participate, did not submit applications for participation. The Savelovsky District Court of Moscow City terminated the proceedings in the case on the recovery of wages from the Client of the Bureau of Lawyers “De Jure” in the amount of 126 thousand rubles due to the Plaintiff’s refusal of the claim. Lawyers of the Bureau of Lawyers “De jure” during the negotiations managed to convince the Plaintiff to resolve the dispute through conciliation procedures.
