The Moscow Arbitration Court refused in full to satisfy the application of the Federal Tax Service of Russia for inclusion in the register of claims of the Debtor-citizen, who is the Principal of the Bureau of Lawyers “De jure”. As part of the dispute, the lawyers of the Bureau prepared reasoned objections to the statement of the tax authority, with which the court agreed and refused the tax authority to satisfy its claims in full. The interests of the Citizen Debtor were represented by Irina Morozova, senior lawyer of the Bankruptcy Dispute Resolution Practice of the Bureau of Lawyers “De jure”.
The Moscow Arbitration Court issued a decision to satisfy the claims of the Principal of the Bureau of Lawyers “De jure” for the recovery of rent and a penalty in full. As part of the dispute, the Defendant’s arguments that he has no debt to the Principal, taking into account the position of the Bureau of Lawyers “De jure” and the evidence presented, were declared untenable. The Defendant was also denied satisfaction of the petition for reducing the penalty, since otherwise it would mean encouraging the Defendant to further non-payment of the debt collected by judicial acts and would violate the balance of interests of the parties. The Principal’s interests were represented by Irina Novikova, senior lawyer of the Bureau of Lawyers “De jure”.
