The Moscow Arbitration Court, considering the case in a simplified manner (the total period of consideration of the case lasted less than two months), satisfied the claim filed by the lawyers of the Bureau of Lawyers “De jure” against the contractor for the recovery of an unearned advance payment in the amount of more than 370 thousand rubles, as well as a penalty and percent. The court applied the moratorium introduced from 01.04.2022 to the penalty and recovered the penalty in part, and the declared interest accrued from the moment the work contract was unilaterally terminated until the date of actual payment of the debt was fully recovered, agreeing with the legal justification of the Bureau that there are no grounds for applying to specified penalties of the moratorium.
