In a dispute with a debtor, lawyers of the Bureau of Lawyers “De jure” defended the legality of the sale at auction of a shopping center building in Moscow. Within the framework of this dispute, the debtor tried to challenge the legality of the bailiff’s actions to sell the property owned by the debtor. This clearly contradicted the interests of the Principal, since it would seriously delay the implementation of the shopping center and the receipt by the Principal of the funds received from the sale. But the lawyers of the Bureau managed to prove the inconsistency of the opponent’s arguments about the violation of the right of first refusal in the enforcement proceedings and in the near future the bailiffs will transfer the proceeds from the sale to the Principal’s account. As a result of the litigation, the Principal received the right to receive rent and a penalty in the amount of more than 20 million rubles under a lease agreement in which he was not a party, but was the mortgagee of the real estate object. The Court of Appeal confirmed the correctness of the lawyers of the Bureau of Lawyers “De jure” and refused to satisfy the tenant’s complaint. Lawyers of the Bureau of Lawyers “De jure” released the Principal from the obligation to pay a performance fee in the amount of more than 3.5 million rubles. As part of the dispute considered by the Basmanny District Court of Moscow, the Bureau’s lawyers managed to prove that the Principal had no signs of wrongfulness in the event of delay in performance, as a result of which he was completely released from recovery.
