The Principal, in a dispute with the Moscow Government, finally proved the correctness of determining the price of the real estate object being bought from the state body. Within the framework of this dispute, the Arbitration Court of the Moscow District upheld the decisions of the lower courts, which satisfied the Principal’s claims to determine the price of the real estate object being purchased from the state body. Lawyers of the Bureau of Lawyers “De jure” managed to defend the position according to which, in case of disagreement with the proposed price, the price of the object can be determined within the framework of a forensic appraisal, which the Defendant did not do. Contrary to the Defendant’s arguments, the State, represented by its body, is not the only entity authorized to determine the price. The dispute about the price is subject to resolution in court as a dispute about the terms of the contract. The Principals managed to recover 2 million rubles as unjustified enrichment! Within the framework of this case, the Moscow Regional Court (after the referral of the case by the court of cassation for a new hearing) satisfied the requirements of our Principals. Lawyers of the Bureau of Lawyers “De jure”, who represented the interests of the Plaintiffs – heirs of the deceased husband of the wife and the father of the daughter, managed to prove that the sister of the deceased brother unreasonably saved the money received by her as a representative of her brother by proxy from the sale of real estate in the Voronezh region. The complexity of the dispute was that the Defendant and her brother during their lifetime did not formalize settlement relations between themselves for the sale of property transferred to the brother by inheritance from the mother.
