The Moscow Arbitration Court satisfied the claim of the Principal and recovered from the Defendant the amount of the penalty, almost 5 times more than the amount of the principal debt! The total amount of satisfied claims was to more than 40 million rubles (7 million 300 thousand rubles of the main debt, 33 million rubles of contractual penalties, 23 thousand rubles as interest under the Article 395 of the Civil Code of the Russian Federation). At the same time, lawyers of the Bureau of Lawyers “De jure” managed to convince the court that there were no grounds for applying the limitation period (work under the contract was completed 6 years ago). This was achieved by proving that the contract is valid, since neither party has declared its withdrawal from the contract. The interests of the Principal were represented by Ilsur Zakirov, senior lawyer of the Bureau of Lawyers “De jure”.
