The Arbitration Court of the Moscow District refused to satisfy the cassation appeal to the Department of State Property of Moscow and left unchanged the judicial act on the recovery of 40 million rubles of unjustified enrichment from the state body in favor of the Principal. During the consideration of the dispute in the court of cassation, the opponents stated that there were signs of abuse of the right on the side of the Principal, in connection with which the judicial acts of lower instances, in the opinion of the state body, should be canceled with a subsequent refusal to satisfy the claim. However, the arguments of the lawyers of the Bureau of Lawyers “De jure” remained irrefutable; we managed to convince the court of the legality of the recovery of unjustified enrichment that arose on the side of the public authority, and the obligation to pay it to the Principal. The interests of the Principal were represented by Semyon Garayan, lawyer of the Bureau of Lawyers “De jure”.
