The Principal retained the real estate within the framework of the enforcement proceedings, but the registration of the transfer of property was suspended due to the presence of several arrests imposed by bailiffs. At the same time, since the Principal was not a party to the enforcement proceedings for such arrests, it was impossible to obtain the necessary information to initiate their cancellation. In this regard, lawyers of the Bureau of Lawyers “De jure” appealed to the court with a claim to declare illegal the inaction of the bailiff on a known proceeding and to demand information about all arrests. After receiving the necessary information, the arrests were removed, and a waiver of the claims was filed with the court, since the final goal was achieved. The Moscow City Court satisfied the requirements of the Principal of the Bureau of Lawyers “De jure” to review the cadastral value of the real estate object and establish it at the market rate. Lawyers of the Bureau, despite the counter-arguments of state bodies, managed to prove that the established cadastral value is too high. The arguments about non-compliance with the established cost were also confirmed by the results of the forensic examination. As a result, thanks to the actions of the Bureau’s lawyers, the Principal’s tax burden was reduced by 25%, and tax savings amounted to 5 million rubles. Gagarinsky District Court of Moscow fully satisfied the claims of the Principal and recovered more than 22 million rubles from the Defendants. When considering the case, the court recognized as justified the demands for the recovery of the loan amount, interest for the use of the loan and the untimely return of the loan amount, as well as penalties for late payment of interest, which should have been paid monthly. It is noteworthy that it was possible to present the arguments and convince the court of the illegality of the non-repayment of the loan and the unreasonable evasion of the guarantors from fulfilling obligations for the borrower within the framework of the very first meeting on the merits of the dispute.
