The Arbitration Court of the Moscow District refused to satisfy the cassation appeal of the bankruptcy trustee for the recovery of expenses for the payment of the attracted specialist in the framework of the insolvency (bankruptcy) case. The courts of three instances supported the positions prepared by the lawyers of the Bureau of Lawyers “De jure” that the bankruptcy trustee had not proved the fact of incurring the costs of paying for the services on the attracted specialist, and also did not prove the validity and legality of attracting a specialist to provide legal services in the bankruptcy case. The arbitration manager, acting in good faith and reasonably, could independently carry out this work, without involving specialists, the payment for whose services is subsequently assigned to the applicant in the bankruptcy case. Thus, the result of the victory won will allow the Principal to avoid paying illegal expenses to the bankruptcy trustee for the attracted specialist. The interests of the Principal were represented by Natalya Safonova, Senior lawyer of the Bureau of Lawyers “De jure”, and Ivan Bychkov, Head of the Tyumen branch of the Bureau of Lawyers “De jure”, took part in the preparation of the legal position.
