The Ninth Arbitration Appellate Court defended the interests of the Principal in a dispute on the recovery of an unearned advance under a work contract in the amount of more than 45 million rubles. During the trial, the Customer insisted that the Contractor had improperly fulfilled its obligations under the contracts for the performance of restoration work, claiming that the work had not been completed by the Contractor in full and with defects, demanded the return of the advances transferred under the contracts and the payment of penalties. During the trial in the court of appeal, the Bureau’s lawyers managed to confirm that the Contractor completed the work in a timely and high-quality manner, and the Customer’s objections to payment for the work performed were unfounded and were not filed in time. Thus, the decision of the court of first instance to refuse to satisfy the claims against the Principal in full was upheld. The interests of the Principal were represented by Konstantin Tkachenko and Yakov Prisyazhnyuk, heads of the practice of the Bureau of Lawyers “De jure”.
