The Arbitration Court of the Moscow Region approved the amicable agreement in the case of the recovery of more than 240 million rubles under a supply contract. The Principal concluded a framework agreement, according to which he undertook to carry out periodic deliveries of goods to his counterparty. However, due to the trusting relationship between the parties at the initial stage of cooperation, their actual relationship under the contract significantly have moved farther away from those that were documented, as a result of which the appearance of unjust enrichment was created on the side of the Principal. Subsequently, relations between the parties to the agreement deteriorated, and one of the parties decided to take advantage of the shortcomings in the legal registration of transactions by presenting disproportionate demands on the Principal. As a result of complex work with evidence and careful study of the legal position, lawyers of the Bureau were able to reveal to the court the true nature of the relationship between the parties. This contributed to the amicable settlement of the dispute and eliminated the risks of unreasonable recovery of more than 240 million rubles from the Principal.
