A member of the Company filed a complaint with the Central Bank of Russia with a request to punish the Company for violating the requirements of the legislation during the general meeting of the company’s participants. If the complaint was satisfied, the Company was threatened with a fine of 500 to 700 thousand rubles, and the general director was fined from 20 to 30 thousand rubles and disqualified for a period of 1 year. The Central Bank of the Russian Federation, having studied the objections to the complaint and evidence prepared by the Bureau of Lawyers “De jure”, completely refuting the arguments of the participant with whom the corporate conflict arose, agreed with the opinion of the Bureau and refused to satisfy the complaint in full. The decision taken by the Central Bank of the Russian Federation is an important success for the business of the Principal, as well as confirmation of the professionalism of the staff of the Bureau of Lawyers “De jure” in protecting the interests of the Principals and ensuring compliance with the law. The Presnensky District Court of Moscow considered two cases at once on the claims of the Principal of the Bureau. By the decision in the first case, the claims of the Principal for the recovery of debt under the loan agreement and foreclosure of the pledged property were satisfied in full, a debt in the amount of more than 1.5 million rubles was collected from the Debtor, including interest and a penalty for the future period. In the second case considered, the Presnensky District Court terminated the proceedings in connection with the approval of the settlement agreement. The debtor agreed with the existence of a delay caused by his fault, as well as with the amount of debt, new conditions on the restructuring of credit obligations were agreed between the parties to the dispute, which made it possible to settle the dispute peacefully. The court agreed with such a peaceful settlement, since it is in the interests of both parties to the dispute.
