The Moscow City Court upheld the decision of the Gagarin District Court of Moscow, which satisfied the Principal’s claim for debt collection on a loan in the amount of more than 60 million rubles, and the opponent’s counterclaim for recognition of the loan agreement as non-monetary was denied. In the appellate instance, the borrower tried to challenge the loan agreement on the grounds of lack of money and insolvency of the lender, supporting the arguments of the counterclaim. But as a result of numerous questions from the court asked during the consideration of the complaint, the court found the position presented by the lawyers of the Bureau of Lawyers “De jure”, together with all the evidence, as convincing and refused to satisfy the opponent’s complaint. The amount recovered by a court decision is more than twice the amount of the loan issued due to interest and penalties. The interests of the Principal were represented by Maria Ovchinnikova, Head of the Department of Legal Support of Contractual and Judicial Work of the Bureau of Lawyers “De jure”.
