The Moscow City Court upheld the decision of the Presnensky District Court of Moscow, which denied the procedural opponents of the Bureau’s Principals their demands to invalidate the auction for the sale of real estate, in which the Principals were recognized as winners. When making the decision, the court took into account the objections of the lawyers of the Bureau of Lawyers “De jure” that on the side of the Principals there were no coordinated actions and anti-competitive agreements aimed at preventing (eliminating) other participants, and by itself, the similarity of the behavior of several entities was not a basis for concluding that there was a competition-limiting agreement between them. It should be noted that this is not the first auction that was contested by the opponents of the Principals, but in none of the disputes did the procedural opponents manage to win over the lawyers of the Bureau of Lawyers “De jure”. These actions of opponents are due to the fact that the properties are located in the area of the so-called “golden mile” of Moscow and are especially attractive to the development market.
