The decision to collect a debt of about 7 million rubles for completed work has come into force!
The Tenth Arbitration Court of Appeal, having considered the complaint of the general contractor and rejecting his arguments, upheld the court’s decision to recover in favor of the Principal of the Bureau debts for work performed and penalties at a rate of 0.1% of the contract price for late payment, which amounted to a total of about 7 million rubles. The defendant’s arguments about the disproportionality of the fines collected and the need to reduce them, taking into account the multiple excess of the key rate and their calculation from the contract price, and not from the amount of unpaid work, taking into account the objections of the Bureau’s lawyer, were reasonably rejected by the court.
