The Arbitration Court of the city of Moscow declared illegal the inaction of the authorized body of the executive power of the Russian Federation, expressed in the refusal to consider the petition for the transfer of land to another category. Despite the absence of administrative regulations and procedural documents establishing the procedure for considering such petitions, the authorized body arbitrarily evaluated the documents attached to the petition and refused the Principal of the Bureau of Lawyers “De Jure” to accept the petition for consideration. Having received another refusal, the Principal applied to the court with a statement challenging the actions (inaction) of the state authority. As a result of the consideration of the case, the court agreed with the arguments of the Bureau’s lawyers and granted the application, obliging the authorized body to consider the petition on its merits. The Principal’s interests were represented by Alexander Uchaykin, senior lawyer of the practice of resolving economic disputes of the Bureau of Lawyers “De jure”.
