Victory in a dispute with the Moscow Government
The Moscow City Court invalidated the decree of the Moscow Government regarding the inclusion of the building belonging to the Principal in the list of objects for which the tax base is defined as the cadastral value.
The key argument was that the tax base calculations presented by the Principal were found by the court to be correct and in accordance with the established rules, while the calculations of the government itself were found to be erroneous.
In addition, the court agreed with the arguments that the building is not a highly profitable facility, such as a shopping or office center, since the share of office and retail space in it is significantly lower than the legally established threshold of 20%.
It is important to note that the position of the Principal was supported by the Prosecutor’s Office, whose participation in such cases is mandatory.
