As part of our Principal’s bankruptcy case, an application was filed to impose subsidiary liability on several individuals. As part of the consideration of this application, the court took interim measures in the form of a ban on individuals from disposing of their property, including real estate.
One of the individuals held liable disposed of the property — giving part of the shopping center to third parties — and we filed a lawsuit challenging this transaction.
More than a year of consideration and here is the victory, the transaction was declared invalid!
In court, we were able to prove that despite the fact that the main dispute about bringing a person to subsidiary responsibility has not yet been completed and there is no final judicial act, the disposal of property during the period of the ban in the form of interim measures is an abuse on the part of a person.
