The Moscow Regional Court overturned the decision of the Istra District Court to recover double the deposit in the amount of over 100 million rubles from the Client of the Bureau of Lawyers “De jure”.
An agreement secured by a deposit was concluded between the parties, but its contents were interpreted differently by the parties. The court of first instance, when considering the case, did not take into account the nature of the relationship that actually developed between the parties, the actual will of the parties, and considered the guilt of the Principal in failing to fulfill the obligation secured by the deposit to be proven. The Court of Appeal disagreed with the decision, the decision was overturned, and the claim against the Client of the Bureau of Lawyers “De jure” was completely denied.
